Erie County District Attorney John J. Flynn announces that 52-year-old Demetrius F. Gore of Buffalo was arraigned this morning before Buffalo City Court Judge Phillip Dabney, Jr. on one count of Attempted Murder in the Second Degree, one count of Assault in the First Degree and one count of Gang Assault in the First Degree (Class “B” violent felonies). 

It is alleged that on Sunday, August 20, 2023, at approximately 1:39 p.m., the defendant, while acting in concert with co-defendant Amari K. Atkins and another unidentified individual, intentionally attempted to cause the death of the victim by repeatedly stabbing, kicking and punching him. The crime occurred on the 1500 block of Broadway near Deshler Street in the City of Buffalo. The victim, 41-year-old male, was taken by ambulance to ECMC where he remains hospitalized with serious physical injuries.

Gore is scheduled to return on Friday, August 25, 2023 at 9:30 a.m. for a felony hearing. He was held without bail.

If convicted of the highest count, Gore faces a maximum sentence of 25 years in prison. 

Yesterday, 27-year-old Amari K. Atkins of Buffalo was arraigned before Judge Dabney on one count of Attempted Murder in the Second Degree, one count of Assault in the First Degree and one count of Gang Assault in the First Degree (Class “B” violent felonies). Atkins, who was also held without bail, is scheduled to return for a felony hearing on Friday morning.

DA Flynn commends Officer Brian Nagy, Detective Carrie Sitarski, and Detective Erin Heidenger of the Buffalo Police Department for their work in this ongoing investigation.   

The case is being prosecuted by Assistant District Attorney Briana R. D. Miller of the Felony Trials Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
