Erie County District Attorney John J. Flynn announces that 29-year-old Calvin Pietri pleaded guilty before Erie County Court Judge Susan Eagan to one count of Aggravated Harassment of an Employee by an Inmate (Class “E” felony). The defendant pleaded guilty to the highest charge on Wednesday, August 16, 2023.

On the evening of November 20, 2020, the defendant, while incarcerated at the Collins Correctional Facility, threw a liquid at the correction officer as he was a collecting dinner tray from the inmate’s cell. The substance was tested and determined to be urine. The correction officer was taken for medical treatment as a precaution. The substance was tested and determined to be urine.

Pietri faces up to 4 years in prison when he is sentenced on Tuesday, October 24, 2023 at 2:00 p.m. when he is sentenced as a second felony offender. The defendant, who has been transferred to Mid-State Correctional Facility, remains incarcerated for a prior conviction.

“Any crime committed by an inmate against a correction officer or jail deputy will be prosecuted to the fullest extent of the law. I hope that the victim feels that justice has been served by this defendant pleading guilty, as charged, for this offense,” said Erie County District Attorney John J. Flynn.
