Erie County District Attorney John J. Flynn announces that 43-year-old Kenneth James of Lockport was arraigned this morning before Buffalo City Court Judge Rebecca Town on one count of Manslaughter in the First Degree (Class “B” violent felony).

It is alleged that on August 14, 2023, at approximately 3:50 p.m., the defendant, with the intent to cause serious physical injuries, shot the victim with a BB gun. The crime occurred as the victim was riding a bicycle on Broadway near Krettner Street in the City of Buffalo. The victim, a 38-year-old male, died at the scene.

James is scheduled to return on Wednesday, August 23, 2023 at 9:30 a.m. for a felony hearing. He was held without bail.

If convicted of the charge, James faces a maximum sentence of 25 years in prison.

DA Flynn commends Det. Sgt. Sean McCabe, Detective Mark Costantino, Detective Adam Stephany and Detective Christopher Sterlace of the Buffalo Police Department for their work in this investigation.

The case is being prosecuted by Assistant District Attorney Frank A. Strano of the Major Crimes Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
