According to New York State Troopers, during a traffic stop on State Route 16 in the town of Olean, officers observed obvious signs of impairment and determined that Jesse E. Smith had been operating his vehicle while in an intoxicated condition. Smith did not have a valid license to operate a motor vehicle at the time of the stop. He was arrested and transported to SP Olean, where a chemical breath test revealed him to have a 0.14% BAC. While in custody, Troopers determined Smith had two previous felony DWI convictions which required the use of an ignition interlock device.
Smith was arraigned in Allegany Town Court and remanded to the Cattaraugus County Jail without bail. He is due to return to Olean Town Court in November.
