Acting DA Mike Keane joined @MayorByronBrown, Commissioner Joe Gramaglia & Chief Craig Macy of @BuffaloNYPolice to announce the arraignment of Dale O. Cummings, 31, on a gun charge as the investigation into the Zenner Street double homicide continues.

Acting Erie County District Attorney Michael J. Keane announces that 31-year-old Dale O. Cummings of no permanent address was arraigned this afternoon before Buffalo City Court Judge Samuel P. Davis, Jr. on one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony). 

It is alleged that on Sunday, April 28, 2024, at approximately 6:17 p.m., Buffalo Police found the defendant in possession of an illegal, loaded gun in the area of East Delavan and Norfolk Avenues. The weapon was submitted into evidence for further analysis. 

Cummings is scheduled to return on Friday, May 3, 2024 at 9:30 a.m. for a felony hearing. He was held without bail. 

If convicted of the charge, Cummings faces a maximum sentence of 15 years in prison.

The defendant is a person of interest in the investigation into a double homicide that occurred over the weekend in the city’s Genesee-Moselle neighborhood. On Saturday, April 27, 2024, at approximately 12:30 p.m., Buffalo Police responded to a reported shooting on the 100 block of Zenner Street. Two victims, a 59-year-old male and a 39-year-old male, were fatally injured by gunfire. One victim was pronounced dead at the scene and the other victim was pronounced dead at the hospital. 

As the investigation remains ongoing, our office will not be releasing a photo of the defendant at this time. Additional charges may be filed. 

Acting DA Keane commends the Buffalo Police Department Homicide Squad and SWAT Unit for their work in this case as well as the Erie County Sheriff’s Office SWAT and Air 1 for their assistance. 

The case is being prosecuted by Assistant District Attorney Christopher S. Safulko and Chief Gary W. Hackbush of the Homicide Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
