Erie County District Attorney John J. Flynn announces that 30-year-old Treviaco D. Calhoun of Buffalo was arraigned yesterday morning before Buffalo City Court Judge Phillip Dabney, Jr. on one count of Making a Punishable False Written Statement (Class “A” misdemeanor).

It is alleged that on August 22, 2022, the defendant knowingly filed a false complaint against a Buffalo Police officer with the department’s Internal Affairs Division. The defendant allegedly stated in a verbal complaint filed over the phone that the police officer punched and body slammed him while placing him under arrest for a disorderly conduct-related incident on August 19, 2022. An investigation by the Buffalo Police Department and our office determined that the information given in the defendant’s sworn statement was false.

Calhoun is scheduled to return on October 25, 2023 at 9:30 a.m. for a pre-trial conference. Bail was set at $1 as the defendant remains in custody after bail was set in two pending criminal cases.

If convicted of the charge, Calhoun faces a maximum sentence of one year in jail.

Calhoun has a total of five additional pending criminal cases.

It is alleged that on January 7, 2023, at approximately 11:56 p.m., Buffalo Police officers observed a stolen vehicle traveling southbound on Bailey Avenue near East Delavan Avenue. The vehicle, a 2020 Kia Optima, had been reported stolen from Amherst the previous day. As officers followed the vehicle, the operator allegedly began driving erratically, lost control of the vehicle and crashed into the front porch of a home on Doat Street. The defendant and two co-defendants are accused of knowingly being in possession of stolen property and operating the vehicle without the owner’s permission.

Calhoun was arraigned the following day before Buffalo City Court Judge Kevin J. Keane. He was released on his own recognizance as the charges were non-qualifying offenses for bail. On June 22, 2023, the defendant was arraigned before State Supreme Court Justice Debra Givens on an indictment charging him with one count of Criminal Possession of Stolen Property in the Third Degree (Class “D” felony) and one count of Unauthorized Use of a Stolen Vehicle (Class “A” misdemeanor). He was held on bail.

It is alleged that on February 14, 2023, at approximately 9:25 a.m., the defendant, with the intent to cause public inconvenience, annoyance or alarm, shouted obscenities while inside the lobby of the Buffalo City Court building on Delaware Avenue in the City of Buffalo. The defendant allegedly refused to exit the building after being asked to leave by court officers. While being placed under arrest for trespass and disorderly conduct, the defendant allegedly refused multiple commands and fought with the officers.

Calhoun was given an appearance ticket. One March 7, 2023, he was arraigned before Judge Dabney on one count of Resisting Arrest, one count of Obstruction of Governmental Administration (Class “A” misdemeanors), three counts of Disorderly Conduct and one count of Trespass (violations). He was released on his own recognizance as the charges are non-qualifying offenses for bail.

It is alleged that on February 24, 2023, at approximately 10:58 p.m., the defendant knowingly and unlawfully entered a nurse station, an enclosed area within the emergency room at ECMC, and refused to leave. It is further alleged that the defendant refused multiple commands and fought with officers while being placed under arrest.

Calhoun was given an appearance ticket. On March 7, 2023, he was arraigned before Judge Dabney on one count of Resisting Arrest, one count of Obstruction of Governmental Administration in the Second Degree (Class “A” misdemeanors) one count of Criminal Trespass in the Third Degree (Class “B” misdemeanor) and one count of Disorderly Conduct (violation). He was released on his own recognizance as the charges are non-qualifying offenses for bail.

It is alleged that on February 26, 2023, at approximately 5:58 a.m., the defendant, while at ECMC, punched a hospital public safety manager in the face and placed the victim in a chokehold. The victim suffered an injury to his face.

Calhoun was initially arraigned later the same morning in Buffalo City Court. Prosecutors requested that the defendant be remanded. Bail was set at $5,000 cash, bond or partially secured surety bond. In June 2023, Calhoun was arraigned on an indictment, charging him with one count of Assault in the Second Degree (Class “D” felony). He was held on bail set at $50,000 cash, bond or partially secured surety bond.

It is alleged that on May 30, 2023, at approximately 7:11 a.m., Buffalo Police officers responded to a complaint of a person who would not leave the premises of a residence on the 400 block of Cambridge Avenue in the City of Buffalo. When the defendant was confronted by police, he allegedly refused orders and fought with officers while being placed under arrest. It is further alleged that while inside of a patrol vehicle, the defendant intentionally kicked the interior of the rear passenger door multiple times, which caused approximately $500 in damage.

Calhoun was arraigned before Judge Dabney on July 11, 2023. He was charged with one count of Criminal Mischief in the Third Degree (Class “E” felony), one count of Resisting Arrest, one count of Obstruction of Governmental Administration in the Second Degree (Class “A” misdemeanors) and one count of Disorderly Conduct (violation). Bail was set at $100 cash, $1,000 bond or $1,000 partially secured surety bond.

Calhoun is scheduled to return on these additional cases on Thursday, October 19, 2023 at 2:00 p.m. for a pre-trial conference.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
