Erie County District Attorney John J. Flynn announces that 28-year-old James Q. Carollo of Crosby, Texas was arraigned last week before State Supreme Court Justice Amy C. Martoche on an indictment charging him with the following offenses:

Two counts of Rape in the First Degree (Class “B” violent felonies)
One count of Sexual Abuse in the First Degree (Class “D” violent felony)
Six counts of Criminal Sexual Act in the Second Degree (Class “D” violent felonies)
One count of Strangulation in the Second Degree (Class “D” violent felony)
One count of Endangering the Welfare of a Child (Class “A” misdemeanor)
It is alleged that between on or about January 1, 2019 and October 31, 2022, the defendant forcibly engaged in sexual intercourse with a child and subjected the victim, who was less than 13-years-old, to sexual contact. The crimes occurred on multiple occasions at a location in the Village of Orchard Park. It is further alleged that on one occasion during the same time period, the defendant obstructed the breathing or blood circulation of the same child by placing his hands on the victim’s throat.

The defendant was arrested on the indictment warrant in mid-July in Houston, Texas. After waiving extradition, the defendant was returned to Western New York on Tuesday, August 1, 2023.

Carollo is scheduled to return before State Supreme Court Justice Deborah A. Haendiges on Wednesday, August 23, 2023 at 9:30 a.m. for further proceedings. He was held without bail. A temporary order of protection was issued on behalf of the victim and the victim’s mother.

If convicted of the highest charge, Carollo faces a maximum of 25 years in prison.

DA Flynn commends Detective Darryl Purucker and Town of Orchard Park Police Department as well as the Harris County Sheriff’s Office for their work in this investigation.

The case is being prosecuted by Assistant District Attorney Meredith M. Mohun of the Special Victims/Domestic Violence Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
