Erie County District Attorney John J. Flynn announces that 48-year-old Luigi Palmieri of Eden pleaded guilty on Tuesday morning before Hamburg Town Court Justice Gerald P. Gorman to one count of Disorderly Conduct (violation). He was sentenced to a one-year conditional discharge.

On May 14, 2022, at approximately 6:35 p.m., the defendant drove slowly past the victim’s home in the Town of Eden as her two children were playing outside. The defendant stopped his vehicle in front of the victim’s residence for no legitimate purpose while knowingly in violation of an existing order of protection. 

The order of protection was issued after a prior criminal case against the defendant was adjourned in contemplation of dismissal on January 4, 2022.

Our office presented the matter before an Erie County Grand Jury. The Grand Jury voted to no bill some of the charges against the defendant, resulting in the cases being dismissed and sealed by operation of law. The Grand Jury voted to charge the defendant with two counts of Criminal Contempt in the Second Degree (Class “A” misdemeanors), which was returned to Hamburg Town Court. On Tuesday, April 11, 2023, the defendant was arraigned then pleaded guilty to the violation in full satisfaction of the charges against him.

A final no contact order of protection was issued on behalf of the victim and her family.
