Erie County District Attorney John J. Flynn announces that 54-year-old Sean M. Brown of Buffalo was arraigned this morning before Erie County Court Judge Susan Eagan on an indictment charging him with two counts of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felonies).

It is alleged that on Saturday, November, 12, 2022, at approximately 6:00 a.m., Buffalo Police found the defendant in possession of two illegal weapons, a handgun and a rifle, while serving an Extreme Risk Protection Order.

Brown is scheduled to return on Wednesday, March 29, 2023 at 9:30 a.m. for a pre-trial conference. Prosecutors requested that the defendant continue to be held without bail. Judge Eagan set bail at $250,000 cash, bond or partially secured surety bond.   

If convicted of the highest charge, Brown faces a maximum sentence of 15 years in prison.

DA Flynn commends the Buffalo Police Department Intelligence Unit and SWAT for their work in this investigation.  

The case is being prosecuted by Assistant District Attorney Andrew S. Criado of the Felony Trials Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
