According to the Niagara County Sheriff’s Office, Carly A. Marrs, 20, of North Tonawanda, had marijuana in her system prior to the crash, but the amount found in her system was minimal, meaning it was not likely to have caused impairment. There was no alcohol in her system at the time of the crash.
The Niagara County Sheriff’s Criminal Division and Accident Investigation Unit determined that a large party was taking place in the area of the accident and several cars were parked on both sides of Shawnee Road. All three pedestrians were standing near the southbound fog line when they were stuck by Marrs’ vehicle.
The Niagara County Sheriff’s Criminal Division and Accident Investigation Unit concluded that the primary causes of the crash were Marrs not reducing her speed — she was determined to be driving at or near the posted 55 mph limit — and the cars parked along the road, which prevented Aronow, Harper and Bird from walking or standing off the roadway.
The Niagara County Sheriff’s Office says attempts to interview the owner of the house where the party occurred were unsuccessful as the owners retained a lawyer following the crash.
Marrs was charged on Friday, according to NCSO and will appear in Town of Wheatfield Court on Oct. 26 to answer to the charges.
