Acting Erie County District Attorney Michael J. Keane announces that Sean M. Croft, 50, of Cheektowaga was arraigned yesterday evening before West Seneca Town Court Justice Jon F. Minear on one count of Driving While Intoxicated, First Offense (unclassified misdemeanor under New York State Vehicle & Traffic Law) and two Vehicle & Traffic Law violations for speeding and unsafely moving from a lane. 

It is alleged that on Saturday, August 31, 2024, at approximately 3:37 p.m., West Seneca Police responded to Nina Terrace near East and West Road for a single-vehicle crash. The defendant is accused of driving a vehicle at a speed in excess of the legal limit when he drove off of the roadway and hit a tree. The defendant was allegedly operating a vehicle while under the influence of alcohol at the time of the crash. The defendant was treated by paramedics and issued an appearance ticket to be arraigned at a later date. 

Croft is scheduled to return on Tuesday, October 15, 2024, at 5:00 p.m. for further proceedings. He was released on his own recognizance as the charges are non-qualifying offenses for bail. His New York State driver’s license was temporarily suspended. 

If convicted of the highest charge, Croft faces a maximum sentence of one year in jail.

The case is being prosecuted by Assistant District Attorney Kurt C. Snuszka of the Justice Courts Bureau. 

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
