Erie County District Attorney Michael J. Keane announces that Cheektowaga Town Court Justice David Stevens found Richard T. Stasiak, 67, of Cheektowaga, guilty of one count of Disorderly Conduct (violation). The defendant was acquitted of the misdemeanor charge. Justice Stevens rendered his decision this afternoon following a non-jury trial earlier today. 

On Monday, March 20, 2023, at approximately 12:00 p.m., the defendant used abusive or obscene language toward the victims in a parking lot outside of a grocery store on Walden Avenue in the Town of Cheektowaga. The defendant yelled racial slurs toward the victims because of a belief or perception regarding the victims’ race. The incident was captured on cell phone video. 

Today, Stasiak was sentenced to a one-year conditional discharge under the conditions that he continue mental health treatment and write a letter of apology to the victims. A final order of protection was issued for both victims, which remains in effect for the next two years.
