Erie County District Attorney John J. Flynn announces that 35-year-old Richard C. Frazier of Buffalo was arraigned this morning before Erie County Court Judge Kenneth Case on an indictment charging them with one count of Attempted Assault in the First Degree (Class “C” violent felony), two counts of Assault in the Second Degree (Class “D” violent felonies) and one count of Endangering the Welfare of an Incompetent or Disabled Person in the First Degree (Class “E” felony).

It is alleged that on April 14, 2023, at approximately 11:00 p.m., the defendant assaulted the victim by beating him repeatedly with his fists and a wooden board. The crime occurred on East Utica Street in the City of Buffalo. The victim, a 29-year-old man, was found unconscious the next morning with injuries to his head and jaw. The victim was taken by ambulance to ECMC. He continues to recover from serious physical injuries.

Frazier is scheduled to return on Monday, July 17, 2023 at 2:00 p.m. for a pre-trial conference. He continues to be held without bail.

If convicted of the highest charge, Frazier faces a maximum sentence of 15 years in prison.

The case is being prosecuted by Assistant District Attorney Andres D. Ortiz of the Special Victims/Domestic Violence Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
