Erie County District Attorney John J. Flynn announces that 30-year-old Kurt T. Surprenant of West Seneca pleaded guilty this morning before Cheektowaga Town Court Justice John J. Wanat to one count of Disorderly Conduct (violation). His co-defendant, 40-year-old Paul Daley of West Seneca, also pleaded guilty to one count of Disorderly Conduct (violation). Today, Surprenant and Daley were sentenced to a one-year conditional discharge and ordered to perform 20 hours of community service.

An investigation began after the United States Department of Homeland Security intercepted a package from China, addressed to Kurt Surprenant, that contained blank COVID-19 vaccination cards. Investigators conducted a controlled delivery of the package to the defendant’s address and obtained a search warrant for his home.

During the course of the investigation, the defendant was found to have obtained a falsified vaccination card from his friend Paul Daley. Daley, an officer with the West Seneca Police Department, was off-duty at the time of the incident. Our investigation determined that the falsified card was never used.

DA Flynn commends the U.S. Department of Homeland Security, FBI, New York State Department of Health Vaccination Complaint Investigation Team and Erie County Department of Health for their work in this investigation.

The case was prosecuted by Chief Gary M. Ertel of the Special Investigations and Prosecutions (SIP) Unit.
