A 39-year-old Sinclairville man was charged with Assault 3rd Degree, Criminal Obstruction of Breathing, and Criminal Mischief 4th Degree on October 24, 2018 following a domestic incident.

According to New York State Troopers and Chautauqua County Sheriff Deputies, officers responded to a Sinclairville residence for a report of a domestic dispute. Upon arrival, the responding officers located a female victim who stated that she was choked and struck multiple times by Richard Banach II, and that Banach had also damaged her vehicle with an axe. The victim had visible injuries that supported her claims and was subsequently transported to an area hospital by ambulance for further evaluation. Banach had fled the scene prior to the officers’ arrival, but was located later in the day by State Troopers and placed under arrest.

Banach was processed at SP Jamestown, arraigned in the town of Charlotte Court and remanded to the Chautauqua County Jail.
