HINSDALE — A 23-year-old Olean man was charged Saturday with driving while intoxicated, first-degree aggravated unlicensed operation and resisting arrest following a report of a vehicle in a ditch.

According to New York State Police, Troopers were sent to Redding Road for a vehicle in the ditch.  The vehicle was unoccupied and following a brief investigation they were able to locate the operator, Kevin Ryan.  They observed signs of intoxication along with an odor of alcoholic beverages coming from Ryan.  SFSTs were administered and he was arrested for DWI.  While attempting to place Ryan in the back of the police car he began to physically resist shouting, “I’m resisting! I’m resisting!” and he was eventually secured in the vehicle. 
While at SP Olean for processing Ryan refused to submit a sample to determine his BAC, and a criminal history check revealed a prior DWI conviction.  He was arraigned in Humphrey Town Court where the judge released Ryan on his own recognizance.
