Erie County District Attorney Michael J. Keane announces that Bradley K. Hudak, 56, of Orchard Park, was sentenced yesterday afternoon before State Supreme Court Justice Debra Givens. He received an indeterminate sentence of 1 to 3 years in prison.  

Between on or about January 2018 and June 2022, the defendant fraudulently obtained approximately $269,272.92 from the retirement account of an elderly family member who also resides in the Town of Orchard Park. The defendant, who was the victim’s power of attorney, withdrew funds from the retirement account and transferred the money to his personal bank accounts. The defendant also fraudulently obtained approximately $10,000 from the victim, which had been designated to a pre-paid funeral expense account. 

In addition, the defendant, while working as the coach of the former “Southtowns Shock” team, admitted to stealing more than $3,000 from the little league baseball team’s bank account. The defendant used the money from team fees to pay for his own personal expenses. 

Hudak pleaded guilty to one count of Grand Larceny in the Second Degree (Class “C” felony) and one count of Grand Larceny in the Third Degree (Class “D” felony). The defendant pleaded guilty to the highest sustainable charges in October 2023. As a condition of the plea, Hudak signed a Confession of Judgment to pay full restitution of $279,272.92 to the elderly victim. He has not paid back any of the stolen money.  

DA Keane commends Officer Kelly Wyrough of the Town Orchard Park Police Department and the Center for Elder Law & Justice for their work in this investigation. 

The case was prosecuted by Assistant District Attorney Brian P. Dassero of the Special Investigations and Prosecutions (SIP) Bureau.
