LOCKPORT — Niagara County District Attorney Brian D. Seaman announced that an indictment was unsealed in Niagara County Court on May 9, 2024, charging Gregory Perry, 31 years old, of Town of Niagara, and Ashley McMillen, 35 years old, of Niagara Falls, in the kidnapping of Rodney Haynes, Sr. 77 years old, also of Town of Niagara. The indictment is the culmination of an investigation by the Niagara County Sheriff’s Office and the Town of Niagara Police after receiving a report of a missing person on March 26, 2024.
Perry is charged with Kidnapping in the First Degree, Robbery in the Second Degree, Aggravated Criminal Contempt and Endangering the Welfare of a Child for the incident on March 26, 2024. In addition to those charges there is an additional count of Criminal Contempt in the Second Degree, related to the same victim, for an incident that occurred on July 29, 2023. As well as charges of Tampering with a Witness in the Fourth Degree and Criminal Contempt in the Second Degree for an incident that occurred on April 10, 2024.
McMillen is charged with Kidnapping in the First Degree, Robbery in the Second Degree and Endangering the Welfare of a Child for the incident on March 26, 2024.
The defendants were arraigned by County Court Judge John Ottaviano. Ottaviano remanded Perry to the Niagara County Jail and set bail in the amount of $100k cash, $200k bond and $1 million partially secured for McMillen.
A charge is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
