Erie County District Attorney John J. Flynn announces that 36-year-old Justin Barker of Kenmore was sentenced this morning before Erie County Court Judge Sheila A. DiTullio to 6 months in jail followed by 10 years of probation with sex offender conditions. He will be required to register as a sex offender upon his release from custody.
Between on or about March 2018 and October 2019, the defendant, being 18-years-old or more, engaged in sexual conduct on multiple occasions with another person who was less than 15-years-old. The crimes occurred at locations in the Town of Amherst and City of Buffalo.
Barker pleaded guilty to two counts of Criminal Sexual Act in the Second Degree (Class “D” felonies), the highest counts in the indictment against him, on November 21, 2023. Today, a final order of protection was issued on behalf of the victim, when remains in effect until February 2034.
DA Flynn commends the Amherst Police Department and the New York State Police for their work in this investigation.
