Erie County District Attorney John J. Flynn announces that 28-year-old James Q. Carollo of Crosby, Texas was sentenced this afternoon before State Supreme Court Justice Deborah A. Haendiges to 12 years in prison followed by 20 years of post-release supervision. Carollo will be required to register as a sex offender upon his release.

Between on or about July 7, 2020 and on or about September 10, 2020, the defendant forcibly engaged in sexual intercourse with a child who was less than 14-years-old. The crime occurred at a location in the Village of Orchard Park. The defendant was known to the victim. 

Carollo was arrested on the indictment warrant in Houston, Texas in July 2023. The defendant was returned to Western New York to face prosecution after he waived extradition. He pleaded guilty to one count of Rape in the First Degree (Class “B” violent felony), the highest count in the indictment against him, on December 13, 2023.

Today, a final order of protection was issued on behalf of the victim and the victim’s mother, which remains in effect until August 2063.

DA Flynn commends Detective Darryl Purucker and Town of Orchard Park Police Department as well as the Harris County Sheriff’s Office for their work in this investigation.  

The case was prosecuted by Assistant District Attorney Meredith M. Mohun of the Special Victims/Domestic Violence Bureau.
