Erie County District Attorney John J. Flynn announces that 28-year-old Rickey D. Roberts, Jr. of Buffalo was arraigned on Wednesday morning before Buffalo City Court Judge Rebecca Town on one count of Rape in the First Degree and one count of Criminal Sexual Act in the First Degree (Class “B” violent felonies).
It is alleged that on Friday, December 8, 2023, at approximately 11:00 p.m., the victim was approached by an unknown male in the City of Buffalo. The defendant, who allegedly claimed he was in possession of a gun, is accused of forcibly engaging in sexual conduct and sexual intercourse with the victim while threatening physical harm. After the sexual assault, the victim was able to seek help from Good Samaritans.
Roberts appeared in court this morning and waived the felony hearing. He continues to be held without bail. A return court date has not been scheduled at this time.
If convicted of the highest charge, Roberts faces a maximum sentence of 25 years in prison.
DA Flynn commends the Buffalo Police Special Victims Unit and Erie Crime Analysis Center for their work in this investigation.
The case is being prosecuted by Assistant District Attorney Rebecca A. Fioravanti of the Special Victims/Domestic Violence Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
