Erie County District Attorney John J. Flynn announces that 36-year-old Justin Barker of Kenmore was arraigned yesterday before Erie County Court Judge Kenneth Case on an indictment charging him with three counts of Criminal Sexual Act in the Second Degree (Class “D” felonies), one count of Criminal Sexual Act in the Third Degree (Class “E” felony) and four counts of Sexual Abuse in the Third Degree (Class “B” misdemeanors).
It is alleged that between on or about March 2018 and October 2019, the defendant, being 18-years-old or more, engaged in sexual conduct on multiple occasions with another person who was less than 16-years-old. The alleged crimes occurred at multiple locations in the Town of Amherst and City of Buffalo.
Barker was released on bail set at $75,000 cash, bond or property. A return court date has not been scheduled at this time.
If convicted of the highest count, Barker faces a maximum sentence of up to 7 years in prison.
DA Flynn commends the Amherst Police Department and the New York State Police for their work in this investigation.
The case is being prosecuted by Assistant District Attorney Rebecca A. Fioravanti of the Special Victims/Domestic Violence Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
