Erie County District Attorney John J. Flynn announces that 28-year-old Marshawn Smith of Cheektowaga pleaded guilty on Friday morning before Erie County Court Justice Sheila A. DiTullio to one count of Grand Larceny in the Third Degree (Class “D” felony). 

The defendant admitted to stealing cash from her employer on seventeen separate occasions between April 20, 2022 and August 18, 2022. The defendant, while working as a manager of a store in the Town of Cheektowaga, was responsible for making nightly cash deposits. The defendant stole a total of $66,298.00 from the deposit banking bags over the course of four months. The theft was discovered after an internal audit detected a series of cash deposit shortages. All of the short bank deposits occurred during the defendant’s shifts, which was further corroborated by video evidence. 

As part of the plea, Smith signed a Confession of Judgement in favor of her former employer in the amount of $66,298.00. To date, no restitution has been paid to the victim.

Smith faces a maximum of 7 years in prison when she is sentenced on Tuesday, April 18, 2023 at 10:00 a.m. She continues to be released on her own recognizance.
