On August 6, 2020 the Bureau of Criminal Investigation out of SP Fredonia arrested Nicholas P. Mineweaser, 24 of Lakewood, NY for Vehicular Manslaughter 2nd degree (D Felony) and Driving While Impaired by Drugs.

On February 24, 2020 at approximately 4:10 P.M., Troopers and the Bureau of Criminal Investigation (BCI) out of SP Fredonia responded to State Route 60 in the town of Pomfret, Chautauqua County for a three-vehicle collision.  Preliminary investigation revealed that a 2009 Hyundai operated by Mineweaser, was traveling northbound on State Route 60 and rear-ended a 2016 Kia that was stopped in the northbound lane waiting to turn left into a parking lot.  The 2016 Kia was pushed into the southbound lane and struck by a 2016 Volvo tractor-trailer traveling southbound.  The occupants of the Kia, 35-year-old operator and 7-year-old passenger, Emmaline A. Wilcox both of Cassadaga, NY were transported to Brooks Memorial Hospital.  The operator was treated for non-life-threatening injuries.  The passenger, Emmaline Wilcox was pronounced deceased at Brooks Memorial Hospital.

Mineweaser had the odor of marijuana at the scene and a DRE from the Fredonia Police Department assisted in the investigation with SFST’s which Mineweaser showed signs of intoxication.  Later confirmation of a toxicology indicated that Mineweaser was intoxicated by drugs. 

The Chautauqua County District Attorney’s Office, NYSP Collision Reconstruction Unit, Commercial Vehicle enforcement Unit, Fredonia Police Department assisted in this investigation.
