A 45-year-old Jamestown woman was charged with Felony Driving While Intoxicated, Aggravated Unlicensed Operation 1st Degree, two counts of Criminal Possession of a Controlled Substance 7th Degree, and Possession of a Controlled Substance in a non-original container on September 25, 2018 following a rollover traffic accident.

According to New York State Troopers, the Frewsburg Volunteer Fire Department responded to a roll-over accident on Sawmill Run Road in Frewsburg and observed Robin Smith to be the sole occupant of the vehicle. Smith was removed by Frewsburg Fire and placed under arrest after failing several SFSTs. Smith was found to be in possession of morphine and clonazepam, both controlled substances for which Smith did not have a prescription. Smith was transported to SP Jamestown where she provided a breath sample of .15. As Smith’s driving record revealed that she had been convicted of DWI within the preceding 10 years, the charge was upgraded to a felony. Smith’s license was also revoked for an alcohol-related conviction.  Smith was then processed, issued tickets returnable to the town of South Valley Court and released.

Smith is scheduled to appear in the town of South Valley Court next month to answer the charges. Smith was uninjured in the accident.
