A 36 year old Dunkirk man was charged with Criminal Possession of a Controlled Substance 4th Degree, Criminal Possession of a Controlled Substance 5th Degree, and two Counts of Criminal Possession of a Controlled Substance 7th Degree on July 22, 2018 following a call to police about a suspicious male.

According to New York State Troopers, officers responded to a TJ Maxx parking lot in Dunkirk for a report of an individual possibly using narcotics. Uopn arrival the Troopers observed Justin Schuk slumped over the wheel of a BMW, unresponsive. Multiple items of drug paraphernalia were observed inside the vehicle in plain view along with large amounts of a white powdery substance. Schuk was awakened after multiple attempts. Schuk was evaluated by EMS and he refused medical treatment. A search of Schuk and his vehicle revealed 12 grams of heroin, 3.2 grams of cocaine, a straw containing cocaine residue and four Buprenorphine pills in an Altoid container for which Schuk did not have a prescription.

Schuk was placed under arrest, transported to SP Fredonia and processed. Schuk was then arraigned in the town of Dunkirk Court and remanded to the Chautauqua County Jail.
