ROCHESTER — Juan Ramon Montoya-Martinez, 35, of El Salvador, who was convicted of unlawful reentry following deportation for an aggravated felony, was sentenced to seven months in prison by U.S. District Court Judge Charles J. Siragusa. The Court also ordered that the defendant be turned over to the Department of Homeland Security upon his release to be deported back to El Salvador.

Assistant U.S. Attorney Craig R. Gestring who handled the prosecution of the case, stated that in September 2016, the United States Border Patrol encountered the defendant, a native and citizen of El Salvador illegally present in the United States, in Spencerport. Records checks showed that the defendant was previously deported from the United States in 2003, following his conviction for Aggravated Sexual Abuse related to his rape of a 13 year-old child in Maryland.
