
CLARENCE — A 25-year-old Hamburg man is facing DWI charges following a one-vehicle crash on Lapp Road early this morning.
According to Erie County Sheriff Tim Howard, at approximately 3:15 a.m., a passerby called Sheriff’s dispatch about a single-vehicle crash in which the vehicle struck a tree, and the driver was unresponsive. Deputies responded to the scene, where firefighters were extricating the driver.
Deputies interviewed Brendan Fogarty and determined he was impaired. An initial breath screening indicated the individual was nearly three times the legal limit.
Fogarty was transported to Erie County Medical Center for non-life-threatening, upper body injuries, arrested and charged with DWI and several vehicle and traffic infractions including drinking alcohol in a vehicle, speeding, and a seat belt violation.
