BUFFALO — A 33-year-old Buffalo man pleaded guilty today in U.S. District Court to being a felon in possession of ammunition. The conviction carries a maximum penalty of 10 years in prison and a $250,000 fine.
Assistant U.S. Attorney Brendan T. Cullinane, who is handling the case, stated that on November 25, 2015, the Erie County Sheriff’s Office executed a search warrant at Darryl Bagby’s residence at 116 Bidwell Pkwy. in Buffalo. Deputies recovered two rounds of ammunition, more than $19,000 in cash, cocaine, a digital scale, and other drug paraphernalia. Further investigation determined that the ammunition was manufactured in Russia and Minnesota. As a prior convicted felon, Babgby is prohibited from legally possessing ammunition.
The plea is the culmination of an investigation by the Erie County Sheriff’s Department, under the direction of Timothy Howard, and the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Acting Special Agent in Charge Charlie J. Patterson, New York Field Division.
Sentencing is scheduled for Jan. 26.
