ORCHARD PARK — A 39-year-old Tonawanda man was charged Wednesday evening with driving while intoxicated after striking several traffic cones on SR 219.

According to New York State Police, Troopers stopped William J. Hayes around 7:38 p.m. after seeing him strike the construction cones on the southbound highway. Hayes told Troopers he had been using his mobile phone, which was why he struck the cones, but police determined him to be intoxicated.

He was charged with DWI and use of a mobile device while operating a motor vehicle. He was then taken to the Boston Troopers barracks and found to have a .14 percent blood alcohol content.

He was later released to a third party to appear before the Town of Orchard Park Court on Sept. 26.
