A pair of Niagara County men were indicted Tuesday on charges of conspiracy to distribute and receive child pornography, distribution of child pornography, receipt of child pornography and cyberstalking.

Charged were 26-year-old Travis Guerriera of Olcott and 25-year-old Timothy Laubacker of Lockport. The charges carry a minimum penalty of 5 years in prison and a maximum of 20 years. Laubacker also faces charges of production of child pornography and attempted production of child pornography, which carry a minimum penalty of 15 years in prison and a maximum sentence of 30 years and a $250,000 fine.

Assistant U.S. Attorney Mary Catherine Baumgarten, who is handing the case, stated that according to the indictment and information revealed in court, in September, 2015, a female told the Niagara County Sheriff’s Office that she had received unsolicited communication from an individual on Facebook threatening to distribute and post images she had sent to her then-boyfriend — Guerriera — when she was 14 years old.

During the investigation, it was determined that Laubacker was the individual that had contacted the female on Facebook. The investigation also concluded that Guerriera had shared the initial images with Laubacker.

The female did not send the photos Laubacker requested. The Department of Justice says he then posted a link of pornographic images of the girl on the Internet.

Court documents state that in June of 2015, Laubacker had attempted to entice a second female to produce pornographic images. When the second female didn’t comply, Laubacker threatened to distribute images that he claimed to have of her. These threats continued until November. 
Laubacker had made initial contact with the second female during his former employment as a behavioral health aide at a mental health facility, a position he was reportedly terminated from in December for inappropriate communications with another minor female. 
Following their arraignments on Tuesday, Laubacker was released on bail while Guerriera awaits a detention hearing, slated for Monday.
