LEROY — A 45-year-old Erie, Pa. man was charged Thursday night with DWI, menacing, criminal mischief and criminal possession of a weapon after police say he caused a scene at the 490 Truck Stop.

According to New York State Police, Brett T. Hersperger had become verbally abuse and threatening toward two employees of the truck stop, while throwing cookies, candy bars, and a lit cigarette at them. The employees were struck with food products which were damaged and could not be sold.

Troopers determined Hersperger had driven to the truck stop and was intoxicated and an illegal billy club was located in his vehicle, leading to the DWI and weapons charges.

Hersperger was arraigned in the Town of Leroy Court and remanded to the Genesee County Jail in lieu of $25,000 bail.

Genesee County deputies assisted on scene.
