BUFFALO — A 27-year-old Buffalo man was sentenced this week to 2-6 years in prison following a guilty plea he entered in an identity theft case, according to Acting Erie County District Attorney Michael J. Flaherty, Jr.

Jerry Nicolas of Tioga Street had pleaded guilty on Feb. 16 to first-degree identity theft, first-degree scheme to defraud, second-degree criminal possession of a forged instrument, and second-degree attempted criminal possession of a forged instrument.

Court records state that between Oct. 22 and Dec. 1, Nicolas stole more than $39,000 worth of merchandise from 31 different banks and merchants using the identity of an unsuspecting victim from Austin, Texas.

Justice Burns signed a restitution order filed as a judgment against the defendant.
