FRANKLINVILLE — A 41-year-old man and a 46-year-old woman — both from Franklinville — were arrested Thursday on charges stemming from a fatal motor vehicle crash that occurred in 2015.

According to New York State Police, Troopers from SP Olean and SP Machias investigated a one-car motor vehicle accident that occurred Oct. 23, 2015 in the Cattaraugus County Town of Humphrey, where vehicle occupants fled from the scene. The victim, Steven J. Kessler, age 39, of Grand Island, NY succumbed to injuries sustained in the accident. 

Investigation revealed that Brian C. Shobert, and Michele L. Harter were the other occupants of the car at the time of the crash.  Cattaraugus County District Attorney Lori P. Rieman presented the case to Grand Jury and received indictments against Shobert for second-degree vehicular manslaughter, criminally negligent homicide, driving while intoxicated, first-degree reckless endangerment and leaving the scene of a personal injury accident. Harter, meanwhile, was indicted on first-degree reckless endangerment.

Both were arraigned in Cattaraugus County Court where Shobert was ordered to be held in Cattaraugus County Jail on $25,000 bail/$50,000 bond and Harter was released under the supervision of Cattaraugus County Probation.
